To be entitled to compensation under a Workcover claim you must demonstrate that your injury, illness or disease has been contributed to by or has a connection with your employment.

It is extremely important when lodging your Workers’ Injury Claim Form that it is completed appropriately, otherwise it may have an impact on your entitlement to compensation and/or your right to a Common Law claim.

If your claim is for weekly payments, your Worker’s Injury Claim Form must be accompanied by a Workcover Certificate of Capacity. This can be obtained by visiting your GP.

The law requires you to lodge a Worker’s Injury Claim Form as soon as practicable from when you become aware of your injury, illness or disease.

Your employer has 10 days to submit your Worker’s Injury Claim Form to the insurer once received.

If your claim is for weekly payments, the insurer has 28 days from receiving the Worker’s Injury Claim Form to accept or reject liability. Should liability be rejected, the matter can be referred to the Accident Compensation Conciliation Service for review.
